Since Bill C-92 (Also referred to as An Act respecting First Nations, Inuit and Métis children, youth and families ) has come into force on January 1, 2020 we have advised and closely worked with our First Nation and Indigenous Governing body clients in drafting and developing legislative, program and system mechanisms in order for them to sufficiently and effectively exercise their inherent jurisdiction over the care of their own children and families in accordance with their own traditional laws and values.
Rather than continuing to adopt unsuccessful colonial models of child and family services we assist our First Nation clients and communities to assume jurisdiction over the care of their own children and the establishment of laws, programs and systems that truly reflects their own laws, values and traditions. In accordance with and through the mechanisms provided by Bill C-92, we have assisted our clients to address the critical need for a child and family services model that truly reflects and recognizes the key role of Indigenous culture and community in the life of an Indigenous child.
Meet Our Legal Team
Gordon Kirkby
Gordon Kirkby was admitted to the Saskatchewan Bar in 1985 and is a partner with the KIRKBY FOURIE law firm in the City of Prince Albert, Saskatchewan. Gordon was born and raised in Saskatchewan. Gordon graduated with a Bachelor of Science Advanced in Mathematics, magna cum laude and a law degree from the University of Saskatchewan and has practised extensively throughout northern Saskatchewan, developing strong ties to various local communities in the province. Gordon’s knowledge of government workings was greatly enhanced by his service as mayor of Prince Albert, followed by being elected as a Member of Parliament. Gordon served as Parliamentary Secretary to the Minister of Justice and Attorney General for Canada, Chair of the Standing Committee for Natural Resources, Chair of the Standing Committee for Aboriginal Affairs, Northern Development and Chief Federal Negotiator. Gordon is also a past Member of the Board of Governors, University of Saskatchewan and the Board of Police Commissioners in the City of Prince Albert. Gordon has extensive experience in all areas of Aboriginal law, including constitutional litigation, regulatory law, Specific Claims, governance and business development. Gordon’s 30+ combined years of experience in the legal and political arenas has allowed him to be particularly effective in a wide range of legal work helping to develop productive relationships between various local communities, companies, and/or governmental entities. Gordon also has extensive experience as a criminal defence lawyer at various levels of court. Gordon, an avid hunter and fisherman in his spare time, lives in Prince Albert, Saskatchewan with his wife celebrated Canadian author Mary-Ann Kirkby and son Levi Kirkby.
Philip Fourie
Philip Fourie, B.L.C., LL.B., M.Env.Mgmt. (Dist.), is a Partner with the KIRKBY FOURIE law firm in the City of Prince Albert, Saskatchewan. Philip is a former Military Judge, federal crown prosecutor, Government legal adviser, and Governor of The Saskatchewan Trial Lawyers Association. Philip serves on the Board of Directors of several charitable organizations and companies including the Victoria Hospital Foundation and the Prince Albert Downtown Improvement District. Over the past 12 years Philip has acted as litigation counsel in several National high-profile public interest Constitutional Law and Administrative Law cases. Philip has also acted as general and litigation counsel for various Aboriginal Groups and First Nations. He has personally conducted more than 300 Residential and Day School hearings in various provinces on behalf of First Nation clients. His general practice includes a special emphasis on Aboriginal Law, Employment Law, Child and Family Services, Civil Litigation and Administrative law. Philip resides in Prince Albert with his wife, Noelene le Roux-Fourie and his three sons.

Roman Iatsenko
Roman graduated from the University of Internal Affairs in Ukraine in 2010. His specialization is civil and commercial law. From 2010 to 2012, he worked as an attorney assistant in a private law firm and practiced in fields of commercial and civil law. The majority of his practice was related to the sphere of bankruptcy of legal entities. In 2012 he moved to Canada. Since 2016 he attended KIRKBY FOURIE law firm on a permanent basis as a volunteer to familiarize himself with the Canadian common law system. At present Roman has completed his legal education in Canada by attending Peter Allard Law School in University of British Columbia as a full-time student. He was called to the Bar of Saskatchewan in 2022 and since that time he has been working at KIRKBY FOURIE law firm as an associate. He is practicing in the field of criminal, immigration law, personal injury, and no-fault claims.
